This bill modifies the existing Nevada law (NRS 108.477) regarding how storage facility owners can advertise and sell personal property to satisfy an unpaid storage lien. Currently, owners must advertise the sale twice in consecutive weeks in a local newspaper; the proposed bill changes this to require only one advertisement in the week immediately preceding the sale. The bill also provides a new alternative for advertisement in judicial districts without a local newspaper: instead of posting physical notices in six conspicuous places, owners can now post the sale advertisement on a publicly accessible internet website. Additionally, the bill eliminates the requirement that the advertisement include a general description of the personal property being sold, simplifying the advertising process. The core purpose remains the same: to provide a legal mechanism for storage facility owners to recover unpaid rent or charges by selling an occupant's stored personal property after providing appropriate notice. The bill maintains existing protections for occupants, such as the requirement to conduct the sale in a commercially reasonable manner and to retain excess proceeds for the occupant for up to one year.
