This bill introduces new disclosure requirements for political action committees (PACs) to prevent misleading solicitations, particularly those that might appear to be charitable but are actually political in nature. Specifically, the bill requires PACs to include clear disclaimers when using a candidate's name, image, or likeness without their permission, explicitly stating that the candidate has not authorized or approved the solicitation. For solicitations that seem to be for electoral or political purposes, PACs must now disclose the five largest recipients of their expenditures in the previous calendar quarter, along with the total amount spent on each. The bill empowers the State Administrator of Elections to investigate potential violations, issue subpoenas, and conduct hearings. If a violation is found, the State Board may prohibit the offending organization from soliciting contributions for a specified period or impose a civil penalty up to $10,000. Importantly, violations of this section will not result in criminal penalties or investigation by the State Prosecutor. The bill aims to increase transparency in political fundraising and protect donors from potentially deceptive solicitation practices, taking effect on July 1, 2025.
