This bill requires parental notification and provides intervention rights for parents when an unemancipated minor (under 18) seeks an abortion. Specifically, it mandates that any person or organization performing or assisting with an abortion for a minor must provide written notification to the minor's parents at least 96 hours before the procedure, either by personal delivery or certified mail. The bill allows for a court waiver of notification only in cases of clear and convincing evidence of physical abuse by the parent. Parents are also granted the right to seek a federal court injunction to prevent the abortion, with the court required to temporarily halt the procedure until a final judgment is reached. Violations of the notification requirements can result in fines up to $100,000 and/or up to one year in prison. The bill includes a medical emergency exception that allows for an abortion without parental notification if a separate physician determines the minor's life is at imminent risk. The law defines "parent" to include legal guardians and does not preempt state laws with more stringent parental notification requirements. The act would take effect immediately upon enactment and contains a severability clause to ensure that if any part of the law is found unconstitutional, the remaining provisions would remain in effect.
