This bill, named the "NYPD highway officer Anastasios Tsakos act," introduces a new legal provision requiring individuals convicted of certain alcohol-related vehicular homicide offenses to pay child support if their actions result in the death of a parent or guardian of a minor child. Specifically, for convictions of vehicular manslaughter or aggravated vehicular homicide due to alcohol influence, the sentencing court must order the offender to provide financial support to the deceased victim's children until they reach 18 and graduate high school. The court will determine a reasonable support amount by considering factors such as the child's financial needs, the surviving parent's resources, the child's standard of living, physical and emotional condition, and educational requirements. Payments will be made through the court clerk and sent to the child's surviving parent or guardian. If the offender is incarcerated, they will have up to one year after release to begin payments. The bill also includes provisions to prevent double recovery, such as offsetting court-ordered child support if the surviving parent subsequently wins a civil lawsuit against the offender. The act takes effect immediately and applies to offenses committed on or after its enactment date.
