AN ACT to amend the mental hygiene law, in relation to duties of providers of services for the developmentally disabled

This bill requires providers of residential services for developmentally disabled children to install surveillance cameras with sound capabilities in all public common areas of their facilities, including living areas, dining areas, hallways, classrooms, and time-out rooms. These requirements apply to group homes, residential and day schools, and programs licensed, certified, funded, or operated by state offices serving children or adults with mental or physical disabilities. Additionally, the bill allows for cameras to be placed in a single-occupancy bedroom of a child aged 13 or younger, but only with the consent of the child's parent or guardian. Providers who fail to comply with these surveillance camera requirements will be subject to a fine of $1,000 per day of noncompliance. The bill is designed to increase transparency and safety in facilities serving vulnerable populations, and will take effect one year after becoming law, giving providers time to implement the necessary surveillance systems.
