This bill enhances the penalties for assaulting a peace officer in Minnesota by changing the legal consequences of such actions. Currently, physically assaulting a peace officer is a gross misdemeanor, but the bill upgrades this to a felony, allowing for imprisonment of up to two years and/or a fine of up to $4,000. The bill also maintains existing provisions for more severe assault scenarios, which remain a felony punishable by up to three years in prison and/or a $6,000 fine. These more serious scenarios include assaults that cause demonstrable bodily harm or intentionally throwing bodily fluids or feces at an officer. The bill defines a peace officer as someone licensed under section 626.845, subdivision 1, who is either making a lawful arrest or performing a legally mandated duty. The new penalties will take effect on August 1, 2025, and will apply to crimes committed on or after that date, giving law enforcement and the judicial system time to prepare for the updated legal framework.
