This bill, known as the "Tennessee Procurement Protection Act," aims to safeguard state and local government procurement processes from undue influence by foreign adversaries by prohibiting the purchase of certain technology products and services. It defines a "foreign adversary" as a country designated by the U.S. Department of Commerce and a "foreign adversary company" as an entity domiciled, headquartered, or controlled by such a country. The act specifically targets "information and communication technology," which includes a wide range of electronic devices, software, and telecommunications services. Under this bill, state agencies and political subdivisions are generally forbidden from procuring final products or services that are manufactured or produced by foreign adversary companies, even if sold through a third-party vendor. Companies bidding on contracts for this technology must certify they are not foreign adversary companies and are not knowingly selling products from them. False certifications can result in significant civil penalties, contract termination, and a five-year ban from state contracts. However, exceptions exist if no other reasonable option is available and the contract is pre-approved after determining that not procuring the technology poses a greater threat to the state.
