This bill provides new regulatory provisions for two types of residential communities in certain Texas counties: manufactured home rental communities and build-to-rent communities. For counties with a specific population profile (over 370,000, bordering the Gulf of Mexico, and adjacent to a county with over 3.3 million people), the bill allows commissioners courts to establish additional minimum infrastructure standards for manufactured home rental communities, including reasonable requirements for lot size, road width, and access points. The bill also introduces a new category called "build-to-rent communities," defined as plots of land with multiple single-family dwellings rented without a purchase option, and exempts these communities from existing subdivision regulations. The commissioners court of a county may establish minimum infrastructure standards for build-to-rent communities after a public hearing and newspaper publication, with standards similar to those allowed for manufactured home rental communities. The changes will apply only to new construction of these communities starting from the effective date of September 1, 2025, allowing time for counties to develop and implement the new standards.
