Bill Summary

AN ACT To amend Titles 36 and 50 of the Official Code of Georgia Annotated, relating to local government and state government, respectively, so as to prohibit certain transactions between government entities and certain foreign persons; to prohibit government entities from acquiring foreign unmanned aircraft systems; to prohibit the use of state funds in connection with such unmanned aircraft systems; to prohibit government entities from operating such unmanned aircraft systems; to prohibit companies owned or operated by a foreign adversary from submitting a proposal for a contract with a state agency for goods or services; to revise and provide for definitions; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill introduces restrictions on government transactions and unmanned aircraft systems (drones) involving certain foreign entities, specifically focusing on companies from China and Russia. The legislation prohibits local and state government entities from acquiring small unmanned aircraft systems (drones weighing less than 55 pounds) manufactured or assembled by "covered foreign entities" domiciled in China or Russia after January 1, 2028. Additionally, the bill expands restrictions on government contracting, making companies owned or operated by foreign adversaries (as designated by the U.S. Secretary of Commerce) ineligible to bid on state contracts. Companies submitting bids must now certify they are not scrutinized companies, and if found to provide a false certification, they can face significant penalties including a civil penalty of $250,000 or twice the contract amount, contract termination, and future bidding ineligibility. Existing equipment and contracts with such entities can be maintained until January 1, 2029, after which they must be discontinued. The bill aims to limit potential national security risks by reducing government interactions with entities from countries perceived as potential strategic competitors.
