This bill addresses the conditions under which former members of several Maryland state retirement and pension systems can return to service without losing their previously earned pension benefits. Specifically, the bill applies to individuals who were members of the Employees' Pension System, State Police Retirement System, Correctional Officers' Retirement System, or Law Enforcement Officers' Pension System on or before June 30, 2011, and who have separated from service under certain circumstances. These circumstances include being separated from employment for 4 years or less, being separated for military service that meets federal reemployment rights requirements, or having the minimum service needed to be eligible for a vested allowance. To qualify, the individual must not have withdrawn their accumulated contributions or become a retiree. When such an individual returns to a position in the same retirement system, they will be subject to the same requirements that applied to members who were in the system on June 30, 2011, and remained members on July 1, 2011. The bill is designed to provide clarity and consistency for pension system members who temporarily leave their public service positions and later return. The legislation is set to take effect on July 1, 2025.
