Bill Summary

AN ACT to amend the correction law, in relation to expanding prison work release program eligibility and participation

AI Summary

This bill expands prison work release program eligibility by modifying several key provisions of the correction law. The bill extends the timeframe for work release eligibility from two to four years for certain incarcerated individuals who were convicted of homicide or assault offenses against a family member or someone with whom they have a child, and who can demonstrate that they were subjected to substantial physical, sexual, or psychological abuse by the victim that was a significant factor in their crime. The bill removes previous restrictions that prohibited work release for individuals convicted of specific offenses, such as drug offenses and certain sexual offenses, and instead creates a more comprehensive list of specific serious offenses that would disqualify an individual from work release, including various degrees of murder, rape, sexual abuse, and other violent crimes. The bill also requires the commissioner to consider all potential credits and reductions, including merit time and good behavior allowances, when calculating an individual's parole or conditional release eligibility. The changes aim to provide more opportunities for rehabilitation and gradual reintegration for incarcerated individuals while maintaining restrictions for those convicted of the most serious offenses.
