This bill amends Tennessee law to provide legal protection for pesticide manufacturers and sellers by limiting their liability in civil lawsuits related to pesticide labeling. Specifically, if a pesticide is registered with both the Tennessee Commissioner of Agriculture and the Environmental Protection Agency (EPA) under the federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and the pesticide's label was EPA-approved at the time of sale, the manufacturer or seller cannot be held liable in civil actions, including product liability claims alleging failure to warn. The protection does not apply if the pesticide was manufactured or sold in violation of state or federal pesticide regulations. This legislation aims to shield pesticide companies from certain legal claims by establishing that compliance with federal labeling requirements at the time of sale provides a defense against subsequent lawsuits. The bill will take effect immediately upon becoming law, as determined by the Tennessee General Assembly.
