This bill amends Delaware law to establish a comprehensive criminal background check requirement for the Department of Finance, mandating that current employees, prospective employees, contractors, and third parties who may access department systems, facilities, or data submit to detailed background screenings. Specifically, individuals must provide fingerprints and other necessary information to obtain both state and federal criminal history records from the State Bureau of Identification and the Federal Bureau of Investigation. The bill introduces a continuous monitoring mechanism where the State Bureau of Identification will provide subsequent criminal history updates to the Department, including information from the Rap Back System (an automated criminal record tracking system). The Department of Finance is granted the right to review and use this criminal background information when determining an individual's employment eligibility or continued access to departmental resources. Current employees and contractors will have 30 days to submit required background check information upon receiving a written request from the Department. This legislation aims to enhance security and ensure that individuals with access to sensitive departmental systems undergo thorough background screening and ongoing criminal record monitoring.
