This bill requires sheriffs, chiefs of police, and town marshals operating county, city, or town jails and detention facilities to develop and implement comprehensive policies for the supervision, care, and treatment of prisoners who are transgender, gender non-conforming, gender non-binary, and intersex. The policy must use respectful language, prohibit discrimination, provide guidelines for housing assignments that consider prisoner preferences, establish protocols for searches that respect prisoner dignity, ensure appropriate medical care, provide access to preferred clothing and hygiene items, and include a fair grievance process. The bill defines key terms like "transgender" (a person whose gender identity differs from their sex assigned at birth), "gender non-binary" (a person whose gender identity doesn't conform to the male/female binary), "gender non-conforming" (a person whose gender characteristics don't match traditional expectations), and "intersex" (a person born with physical characteristics that don't fit traditional binary gender definitions). Additionally, the bill allows (but does not require) jail and detention facility staff to develop cultural competency training for interacting with these populations. Importantly, the legislation does not mandate facilities to construct new buildings or implement additional staff training to comply with the policy.
