AN ACT to amend the executive law, in relation to prohibiting the use of discriminatory advertisement practices in housing

This bill prohibits discriminatory practices in the targeting of digital advertisements for housing opportunities, including rentals, sales, and lending services. It specifically bans targeting based on age, race, gender, or zip code, as well as targeting within a small geographic radius (less than fifteen miles) or using categories related to sensitive topics like political affiliation or religion. The bill also prohibits using tools that create audiences similar to a provided "seed audience" (a group of users used as a basis for targeting) if it results in discrimination based on protected characteristics. The Division of Human Rights is empowered to investigate complaints of such discriminatory advertising and to issue regulations to prohibit new discriminatory targeting techniques, conducting reviews at least every two years. Furthermore, the Division can compel digital advertising platforms to provide access to their algorithms and targeting techniques to investigate complaints or during these reviews, and can order changes to prevent discriminatory results, with platforms having the right to appeal such orders.
