Bill Summary

As enacted, expands from wetlands to all areas that an aquatic resource alteration permit may apply to the areas for which the department of environment and conservation is required to exempt from compensatory mitigation an amount of area equal in size to the area for which mitigation would not be required if the permit applicant qualified for coverage under a general permit, if the only factor that disqualifies an applicant for an aquatic resource alteration permit from having the activities for which a permit is sought covered under a general permit is the size of the area that the permit will apply to. - Amends TCA Title 69, Chapter 3.

AI Summary

This bill expands the scope of an existing Tennessee environmental regulation regarding aquatic resource alteration permits (ARAPs). Currently, the law allows the Department of Environment and Conservation to exempt certain activities from compensatory mitigation if the only reason a permit applicant doesn't qualify for a general permit is the size of wetland impacts. The bill broadens this provision to apply to all areas of aquatic resource impacts, not just wetlands, meaning that if a project's only disqualifying factor from a general permit is the size of its impact on streams, waterways, or other aquatic environments, the department can still exempt that project from full compensatory mitigation requirements. Compensatory mitigation typically requires developers or project managers to restore, create, or preserve environmental resources to offset damage caused by their activities. The bill will take effect on July 1, 2025, and appears designed to provide more flexibility for permit applicants while maintaining environmental protection standards.
