Bill Summary

AN ACT To amend Titles 16 and 19 of the Official Code of Georgia Annotated, relating to crimes and offenses and to domestic relations, respectively, so as to prohibit persons convicted of misdemeanor crimes of family violence from receiving, possessing, or transporting a firearm and to prohibit persons subject to family violence protective orders from receiving, possessing, or transporting a firearm; to provide for definitions; to provide an effective date and applicability; to provide for related matters; to repeal conflicting laws; and for other purposes.

AI Summary

This bill amends Georgia law to prohibit individuals convicted of certain misdemeanor family violence offenses or subject to family violence protective orders from receiving, possessing, or transporting firearms. Specifically, the bill defines a "misdemeanor crime of family violence" as offenses involving domestic relationships (such as spouses, parents and children, or household members) that include the use or threatened use of physical force or firearms. Upon conviction of such offenses or issuance of a protective order, the court must inform the offender in writing about the firearm prohibition, order the surrender of all firearms within 24 hours to a federally licensed firearms dealer, and provide an opportunity for the offender to attest that they do not possess firearms. If the offender does not immediately confirm they have no firearms, the court must schedule a hearing within 72 hours where the offender must either prove they have surrendered their firearms or confirm they have no firearms in their possession. The bill applies to various offenses including simple assault, simple battery, battery, and pointing or aiming a gun at another person. The law will become effective on July 1, 2025, and will apply to convictions and protective orders issued on or after that date, aimed at reducing domestic violence by restricting firearm access for individuals with a history of family violence.
