This bill modifies Maryland insurance law to enhance the notification requirements when a health insurance carrier cancels or chooses not to renew a small group health benefit plan. Under the new provisions, carriers must provide notice at least 90 days before nonrenewal to affected small employers, enrolled employees, and the Commissioner. Within 7 days after cancellation or nonrenewal, carriers must send both a written notice and an electronic notice that complies with existing state law. The notice must now include information about additional health benefit coverage options, specifically mentioning continuation of coverage through COBRA (Consolidated Omnibus Budget Reconciliation Act) if available and plans offered through the Maryland Health Benefit Exchange. The carrier must also offer affected small employers the option to purchase other health benefit plans currently offered in the small group market, and must treat all affected employers uniformly without considering individual health status or claims experience. The bill will apply to all health insurance policies, contracts, and plans issued, delivered, or renewed in Maryland on or after January 1, 2026, effectively updating the notification and transition procedures for small group health insurance coverage.
