This bill allows individuals who are enrolled in an accredited higher education institution or a residential vocational training program to return to an out-of-home placement provider (such as a foster home or group home) under specific conditions. The individual can return during scheduled breaks, temporary campus closures, or temporary leaves of absence if their living arrangement is mutually agreed upon by the individual, the out-of-home placement provider, and the provider agency, and if the Department of Social Services reviews and approves the request. To do this, the individual must submit a request to the local department at least 30 days before the scheduled break. The local department will then make a recommendation to the state department within 21 days, and the state department will make a final determination about the request 14 days before the break. The bill aims to provide more flexibility and support for young people who are pursuing higher education or vocational training while having previously been in an out-of-home placement. The legislation will take effect on July 1, 2025.
