This bill establishes a pilot program for distracted driving monitoring systems in Montgomery County and Prince George's County, allowing the use of automated camera systems to detect and issue citations for various types of distracted driving violations. The program specifically targets drivers using wireless communication devices illegally, such as texting, reading electronic messages, or using handheld phones while driving. The monitoring systems will automatically capture photographic or video evidence of violations, and the registered vehicle owner can be subject to a civil penalty of up to $40 if the vehicle is recorded committing a violation. The bill requires counties to obtain local authorization, install warning signage, and ensure system operators are properly trained and the equipment is annually calibrated. Counties must designate an official to investigate and respond to questions about the program, and the systems cannot be placed in locations without proper notification and a 15-day warning period. Importantly, these citations will not result in points on a driver's record, affect insurance rates, or be considered moving violations. The counties must report on the effectiveness of the monitoring systems by December 1, 2027, and the pilot program will automatically expire on September 30, 2028, unless further legislative action is taken.
