This bill amends Tennessee's criminal procedure law regarding the surrender of criminal defendants by bail bondsmen or sureties. Specifically, the bill requires sheriffs to accept the surrender of a defendant by a bail bondsman or surety, but only in preparation for a hearing to determine whether there is good cause for the surrender. A bail bondsman (or surety) is a professional who posts bail on behalf of a defendant, essentially guaranteeing the defendant's appearance in court, and who can take responsibility for returning a defendant to custody if they believe the defendant may fail to meet their court obligations. The hearing referenced in the bill will be conducted under an existing Tennessee statute (§ 40-11-137) to evaluate the legitimacy of the surrender. The bill adds this requirement as a new subsection to the existing law in Tennessee Code Annotated, and will take effect immediately upon becoming law, as determined by the Tennessee General Assembly.
