Provides that a lease is not permitted under the provisions if the lease may result in the elimination or privatization of existing government-operated services. Provides that the authority to enter into a lease shall be exercised by an ordinance passed by three-fourths of the full county board then holding office, at any regular meeting or at any special meeting called for that purpose. Provides that the term of a lease entered into under the provisions may not exceed 99 years. Provides for the sunset of the provisions. Effective immediately.
AI Summary
This bill amends the Illinois Counties Code to specifically allow counties with a population between 500,000 and 600,000 inhabitants to lease vacant real estate, structures, or facilities owned by the county under certain conditions. The lease must promote economic development, job creation, or community revitalization, and cannot interfere with existing public services. The bill prohibits leasing properties currently used for government-operated services and prevents leases that might eliminate or privatize existing government services. To execute such a lease, the county board must pass an ordinance with a three-fourths majority vote at a regular or special meeting, and the lease term cannot exceed 99 years. Importantly, these provisions will automatically become inoperative (sunset) 5 years after the effective date of the amendatory act. The bill maintains existing provisions for counties to lease other types of property, such as farmland, and continues to require public bidding processes for such leases.
