This bill establishes the "Tennessee Voluntary Do Not Sell Firearms Act," which creates a process for individuals to voluntarily waive their firearm rights by filing a form with their county circuit court clerk. When a person files the waiver, the clerk will verify their identity, transmit the form to the Tennessee Bureau of Investigation (TBI), and the TBI will enter the person's information into the National Instant Criminal Background Check System (NICS) within 24 hours. If the person has a handgun carry permit, it will be suspended. The individual can revoke the waiver after seven days, but must wait 21 days after the TBI processes the revocation before regaining firearm rights. The bill also makes it an offense to sell or transfer a firearm to someone who has an active voluntary waiver, and prohibits the waivered individual from knowingly receiving or possessing a firearm, with a potential civil fine of $100 or four hours of community service for violations. The forms and related records are confidential and can only be disclosed in specific circumstances, such as to law enforcement or the applicant. The act will take full effect on January 1, 2026, though forms and rules can be developed immediately.
