This bill amends the New York State Alcoholic Beverage Control Law to create a new definition for "private label" wine and allow certain restaurants to sell sealed bottles of private label wine for off-premises consumption when a substantial food item is also purchased. Specifically, the bill defines "private label" as an alcoholic beverage with a brand name exclusively owned by a licensed retailer or an entity that has granted a retailer the legal right to use that brand name, and which is sold exclusively by that retailer (or its commonly owned affiliates). The legislation modifies existing regulations to remove restrictions on manufacturers and wholesalers listing private label wines and allows restaurants licensed to sell wine to offer sealed private label wine bottles to customers who are also buying a substantial meal. This change provides restaurants with a new way to generate additional revenue by selling branded wine bottles alongside food purchases, while maintaining existing rules about on-premises alcohol consumption. The bill would take effect immediately upon passage.
