This bill requires the Tennessee Division of Water Resources to submit an annual report by July 1st each year, starting in 2025, providing detailed information about water quality permit applications. The report must include the total number of permit applications filed and specific details about compensatory mitigation methods used in permits. Compensatory mitigation refers to actions taken to offset environmental impacts, such as restoring or creating habitats to compensate for damage caused by development projects. For permits requiring compensatory mitigation, the report must specify the mitigation mechanism (such as mitigation banking, permittee-responsible mitigation, or in-lieu fee payments). If the mechanism is an in-lieu fee program or mitigation banking, the report must also disclose the program or bank sponsor, the number of mitigation credits sold for the project, and the total amount of money received by the sponsor. This report will be submitted to the governor, comptroller, and chairs of relevant legislative committees, and will be prepared in collaboration with the U.S. Army Corps of Engineers as needed. The bill takes effect immediately upon becoming law.
