Under the new law, sellers must provide a written disclosure that either states they are unaware of any drain tiles or provides a detailed map showing the location, diameter, outlets, and drainage water flow path of existing drain tiles. At the time of closing, sellers must complete a drain tile disclosure certificate with specific property and drainage information. The bill mandates that county recorders cannot record property deeds after January 1, 2026, without this disclosure. If a seller fails to disclose known drain tile information, they may be liable for repair costs and attorney fees if the buyer takes legal action within six years of purchase. The Board of Water and Soil Resources will manage these disclosure certificates, collecting a $50 fee per submission and maintaining records for at least six years. The legislation aims to increase transparency in agricultural land sales by ensuring buyers are informed about existing subsurface drainage infrastructure.
