AI Summary
This bill establishes the Native to Illinois Labeling Program within the Department of Agriculture to help Illinois consumers more easily identify plants and seeds that are native to the state. The program creates a certification process for producers of native plants and seeds, requiring them to meet specific eligibility criteria, including that the plant or seed must be living, native to Illinois, and conform to departmental rules. To receive a "Certified Native to Illinois" label, producers must submit an application and may be subject to third-party certification. The labeling requirements are detailed, mandating that labels include the scientific and common names of the plant, its native county or ecoregion, the producer's name, and additional information about the plant's significance and cultivation. The bill imposes strict compliance requirements, with potential penalties of up to $10,000 for knowingly violating the labeling rules, and provides for investigations by the Department of Agriculture. Notably, individuals who knowingly make false statements about plant certification can face a class 4 felony charge and may be barred from obtaining future certifications for at least five years. The overall goal is to support and promote native plant species within Illinois while providing consumers with clear, accurate information about the plants they are purchasing.
