Bill Summary
Amends the Illinois Insurance Code. Provides that, with respect to life insurance final expense policies, no life company authorized to issue those policies in the State shall refuse to insure an individual; refuse to continue to insure an individual; limit the amount, extent, or kind of coverage available to an individual; or charge an individual a different rate for the same coverage solely on the basis that an insured or applicant has been convicted of a felony. Provides that nothing in the provisions shall be construed to require a life company to issue or otherwise provide coverage for a life insurance policy to a person who is actively incarcerated pursuant to a felony conviction. Defines "final expense policy".
AI Summary
This bill amends the Illinois Insurance Code to add new protections for individuals with felony convictions when seeking life insurance final expense policies. Specifically, the bill prohibits life insurance companies from discriminating against individuals solely based on a felony conviction when issuing, continuing, or pricing final expense policies. A "final expense policy" is defined as a policy designed exclusively to cover funeral and burial costs. The bill importantly clarifies that while insurance companies cannot deny coverage or charge different rates based on a felony conviction, they are not required to provide coverage to individuals who are actively incarcerated due to a felony conviction. This provision aims to prevent blanket discrimination against people with criminal records while maintaining insurers' ability to make reasonable risk assessments. The new provision is added as subsection (f) to an existing section of the Illinois Insurance Code that already prohibits various forms of discrimination in life insurance, such as discrimination based on disability, military service, and travel experiences.
