This bill, known as the Restaurant Reservation Anti-Piracy Act, establishes regulations for third-party restaurant reservation services in Illinois. The bill defines a food service establishment as any place providing food for individual consumption, and a third-party restaurant reservation service as a website or mobile application that offers restaurant reservations and is owned by someone other than the restaurant's owner. The legislation requires that these reservation services can only list, advertise, promote, or sell reservations for a food service establishment through a written agreement with that establishment, effectively preventing unauthorized reservation platforms from selling or promoting restaurant bookings without explicit permission. If a third-party reservation service violates these terms, they can be subject to civil penalties of up to $1,000 per violation, with each day of violation counted separately. Customers or restaurants affected by unauthorized reservation services can bring civil actions seeking injunctive relief, damages not exceeding the fees collected by the service, attorney's fees, and other appropriate remedies. Any legal action must be brought within one year of the alleged violation. Notably, the bill excludes reservation distribution channels that have contractual authorization from the restaurant or an authorized reservation distributor.
