Bill Summary

Reinserts the provisions of the introduced bill with the following changes. Provides that no person may install or construct a swimming pool without a permit issued by the (i) the municipality in which the swimming pool is located or (ii) the county in which the swimming pool is located if the swimming pool is not located in a municipality. Provides that, by January 1, 2027, each municipality and each county (rather than only municipalities in the introduced bill) shall, by ordinance or resolution, develop a process to provide for the issuance of permits to construct or install swimming pools. Provides that all permitted swimming pools shall have enclosures inspected by the permitting unit of local government (rather than the permitting municipality in the introduced bill) before the receipt of an initial permit and at least once every 5 years thereafter.

AI Summary

This bill, also known as "Zoe's Law", establishes comprehensive regulations for private residential swimming pools in Illinois. The bill defines a "swimming pool" as an outdoor artificial basin of water on private residential property that is more than 24 inches deep, covers over 25 square feet, or holds more than 200 gallons, excluding commercial pools, above-ground pools over 42 inches high, and jacuzzis. It mandates that all new swimming pools must be completely enclosed by a fence, wall, or permanent barrier at least 42 inches tall, with specific requirements for openings to prevent children from accessing the pool area. The bill requires all municipalities to develop a permitting process for swimming pools by January 1, 2027, and mandates that pool enclosures be inspected before initial permitting and every five years thereafter. While allowing local governments to implement more restrictive regulations, the bill prohibits home rule units from creating less restrictive pool enclosure standards than the state's baseline requirements. The legislation aims to improve swimming pool safety and prevent potential drowning incidents, particularly for children, by ensuring consistent and robust enclosure standards across Illinois.
