This bill establishes a new requirement for firearm manufacturers, gunsmiths, and dealers in New York State to participate in a ballistic identification databank program. The bill defines key terms such as "manufacturer" (a licensed firearms or ammunition producer), "shell casing" (the part of ammunition containing primer and propellant), and "firearm" (including pistols, revolvers, assault weapons, rifles, and other long-barreled weapons). Manufacturers must now include a sealed container with each firearm shipped to the state, which contains a shell casing from that firearm and identifying information. Gunsmiths and firearms dealers must forward these sealed containers to the state police within ten days of selling a firearm. The Division of State Police will create an automated electronic databank to store ballistic information, developing a statewide program with at least five regional locations by January 1, 2027. The program will allow dealers to deliver firearms for testing and prompt return. Violations of these requirements will result in penalties, with first-time violations considered a violation and subsequent violations classified as a class A misdemeanor. The law will take effect 60 days after becoming law, creating a new system to help law enforcement potentially trace firearms used in crimes.
