Bill Summary
AN ACT IN THE COUNCIL OF THE DISTRICT OF COLUMBIA To amend, on a temporary basis, the Condominium Act of 1976 to authorize condominium unit owners’ associations to conduct virtual meetings and clarify voting and quorum requirements for such meetings; to amend section 29-910 of the District of Columbia Official Code to allow cooperatives to conduct remote meetings; and to amend sections 29-1005.06, 29-1005.07, and 29-1008.11(b) of the District of Columbia Official Code to allow limited equity cooperatives to conduct remote meetings.
AI Summary
This bill temporarily amends the District of Columbia's laws to provide more flexibility for condominium unit owners' associations, cooperatives, and limited equity cooperatives to conduct virtual meetings. Specifically, the bill allows meetings of unit owners' associations, executive boards, and committees to be conducted via telephone conference, video conference, or similar electronic means, with the requirement that participants must be able to hear and comprehend each other. The bill enables electronic voting by allowing ballots to be delivered with meeting notices and permitting unit owners to submit votes electronically up to 7 days before a scheduled meeting. For cooperatives and limited equity cooperatives, the bill removes previous restrictions that required authorization in articles or bylaws for remote meetings, effectively making virtual meetings permissible by default. The changes are temporary, set to expire 225 days after the act takes effect, and are designed to provide organizations with more adaptable meeting and voting options, likely in response to challenges posed by recent public health concerns or technological advancements.
