This bill amends the New York Vehicle and Traffic Law to establish a stronger enforcement mechanism for repair shops that fail to pay restitution to customers who have suffered financial losses. Specifically, if a registered or unregistered repair shop is found to have caused financial harm and then fails to comply with an order to pay restitution within 30 days, the commissioner is now required to increase the original penalty. The increased penalty can be up to an additional $500 plus the amount of financial loss, depending on whether the original penalty already included that loss. The bill will take effect on the first of November following its passage into law.
