This bill amends Tennessee law to allow court clerks in counties with a population of 366,200 or more (based on the 2020 federal census) to establish an automatic expungement processing program. Under this program, court clerks can initiate the expungement of public records without requiring a petition from the individual, certification from the Tennessee Bureau of Investigation (TBI), or a court order for certain eligible cases. Specifically, the program covers expungements that would be granted at no cost under existing law, such as cases involving certain types of dismissed charges or other qualifying circumstances. When a court clerk initiates an expungement, other agencies must treat the clerk's notice the same as a court-ordered expungement. The clerk will maintain a confidential record of expunged cases, accessible only to the person whose records were expunged, law enforcement, courts, and other governmental agencies performing official functions. Importantly, the bill clarifies that court clerks are not responsible for maintaining the ongoing expungement program and are not liable for any errors or omissions. The act will take effect immediately upon becoming law.
