This bill, known as the Fostering Competitive Career Opportunities Act, aims to remove unnecessary postsecondary degree requirements from state employment considerations. The legislation addresses "degree inflation" by preventing state employers from making hiring decisions solely based on the absence of a college degree. Under the bill, state employers must establish baseline job requirements that can include direct experience, specific certifications, or course instructions, but cannot automatically require a college degree. Employers may only mandate a degree if they can definitively prove that specific skills for the position can only be obtained through a degree program. For positions where direct experience can be considered in lieu of a degree, the bill establishes equivalency standards: two years of experience for an associate's degree, four years for a bachelor's, six years for a master's, seven years for a professional degree, and nine years for a doctoral degree. The bill also extends to state contractor solicitations, requiring employers to justify any educational prerequisites in their proposals. Political appointments are exempt from these requirements. The overall intent is to expand employment opportunities, reduce barriers to state jobs, and recognize alternative forms of professional qualification beyond traditional academic credentials.
