This bill addresses mental health services, staff training, and confidentiality in Arizona's behavioral health facilities. Beginning October 1, 2026, all staff members of behavioral health facilities will be required to complete annual training that covers two key areas: the rights and responsibilities of guardians (as defined in Title 14), and state and federal laws regarding the disclosure of confidential patient information, including HIPAA (Health Insurance Portability and Accountability Act) privacy standards and rules about sharing mental health and substance use disorder information. The bill also modifies existing laws about patient confidentiality, expanding the circumstances under which healthcare providers can disclose patient information, such as when a patient is considered incapacitated (including situations of temporary psychosis or substance influence) or when there is a serious and imminent threat to the patient's or others' health and safety. Additionally, the bill provides legal protections for mental health providers who disclose confidential information in good faith to prevent potential harm, including allowing disclosure if a healthcare provider reasonably believes a patient's psychosis or intoxication poses a serious threat to another person. These changes aim to improve patient care, staff preparedness, and safety while maintaining appropriate confidentiality protections.
