Bill Summary

AN ACT To amend Article 2 of Chapter 14 of Title 40 of the Official Code of Georgia Annotated, relating to speed detection devices, so as to repeal all laws relative to enforcement of speeding violations in school zones through the use of automated traffic enforcement safety devices; to provide for conforming changes; to prohibit a local governing body or law enforcement agency from entering into or renewing a contract that provides for enforcement of laws relative to speeding violations in school zones through the use of automated traffic enforcement safety devices; to provide for related matters; to provide for effective dates; to repeal conflicting laws; and for other purposes.

AI Summary

This bill eliminates the legal framework for automated traffic enforcement safety devices (commonly known as speed cameras) in school zones in Georgia. Specifically, the bill repeals multiple existing code sections related to these devices, prohibits local governments and law enforcement agencies from entering into or renewing contracts for school zone speed camera enforcement after July 1, 2027, and removes provisions about testing, signage, and fine calculations associated with these devices. The bill maintains traditional speed enforcement methods by law enforcement officers using radar devices, but completely removes the ability to use automated cameras in school zones. The legislation includes a phased approach, with most provisions becoming effective on July 1, 2028, which gives local jurisdictions time to wind down existing contracts and adjust their traffic enforcement strategies. The bill also maintains existing requirements for manual radar device testing and visibility, ensuring that traditional speed enforcement methods continue to be regulated to protect public safety.
