This bill introduces two new uniform acts: the Uniform Easement Relocation Act and the Uniform Mortgage Modification Act. The property owner must bear all relocation expenses and must record a court order and potentially amend related maps. The act explicitly does not apply to public utility easements, conservation easements, or easements associated with public roads. The Uniform Mortgage Modification Act establishes "safe harbor" provisions for certain mortgage modifications, ensuring that such modifications do not affect the mortgage's priority or constitute a new agreement. Eligible modifications include extending maturity dates, reducing interest rates, capitalizing unpaid interest, modifying financial covenants, and adjusting payment schedules. Both acts aim to provide clarity and uniformity in real property law, and they will take effect on October 1, 2025, applying to existing and future easements and mortgage modifications.
