This bill expands existing California traffic safety requirements to provide greater protection for highway maintenance vehicles and other stationary vehicles displaying warning signals. Currently, drivers are required to exercise caution when approaching a stationary Caltrans vehicle with flashing lights by either changing lanes away from the vehicle or slowing down to a safe speed. The bill broadens this requirement to include all marked highway maintenance vehicles (defined as vehicles owned or operated by state, county, municipal, or contracted entities responsible for roadway maintenance) and any other stationary vehicle displaying warning devices such as hazard lights, cones, flares, or retroreflective markers. Drivers must now either change to a non-adjacent lane with careful consideration of safety and traffic conditions or, if lane changing is unsafe, slow to a prudent speed appropriate to the weather, road, and traffic conditions. Violating this requirement remains an infraction punishable by a fine of up to $50. The bill does not apply when these vehicles are separated from the highway by a physical barrier. Notably, the bill includes a provision stating that no state reimbursement is required because the changes relate to creating or modifying an infraction.
