This bill requires counties that impose development impact fees, surcharges, or excise taxes to submit annual reports to the Department of Planning detailing the financial and geographical specifics of these charges. Specifically, counties must report the total amount of fees collected from new construction or development projects, the address and location of developments where fees were derived, and how these funds were used for capital improvement projects related to transportation, school construction or maintenance, or other qualifying projects. The bill applies to charter, code, and commission counties that have enacted such fees. Additionally, counties must make these reports publicly available, either through their website or by other reasonable means. Starting July 1, 2026, counties must also submit a report identifying local laws authorizing the collection and expenditure of these fees, and thereafter must report to the Department of Planning whenever they enact or amend such local laws. Development impact fees are monetary charges imposed on new development to help fund infrastructure improvements necessitated by that development. The bill aims to increase transparency around how these fees are collected and spent by local governments.
