This bill provides a framework for local governments in Tennessee to regulate the sale of hemp-derived cannabinoid products (HDCPs) by establishing local HDCP boards with the authority to create permitting systems for retailers. Under the bill, local governments can form an HDCP board by majority vote, which can then require retailers to obtain a $250 annual permit for each retail location selling these products. The local HDCP board can regulate HDCP sales within its jurisdiction, as long as the regulations do not conflict with state law. Local law enforcement agencies are empowered to enforce these regulations, conduct random inspections of retailers, and can impose penalties for non-compliance, including civil penalties of $1,000 per violation, permit revocation for up to one year, and potential ineligibility for permit renewal. The Tennessee department of agriculture will assist local boards by providing notices of good standing for retailers upon request. All permit fees and penalties will be collected by the local government and deposited into its general fund, to be used specifically for enforcement of these HDCP regulations. The bill will take effect on July 1, 2025, and is designed to provide additional local control over the sale of hemp-derived cannabinoid products while maintaining state oversight.
