This offense is initially classified as a Class C misdemeanor, but becomes a Class B misdemeanor for individuals with a previous conviction for the same offense. The law is set to take effect on September 1, 2025, and allows for prosecution under this new section or other existing legal provisions that might also cover the same conduct.
