This bill prohibits the sale and distribution of anti-fogging sprays or wipes that contain perfluoroalkyl and polyfluoroalkyl substances, commonly known as PFAS substances, which are a class of fluorinated organic chemicals. The bill defines "anti-fogging sprays or wipes" as any product intended to prevent condensation on eyeglasses, and clarifies what constitutes a "manufacturer" for the purposes of this law. It states that no person shall sell these products if they contain PFAS substances as intentionally added chemicals or above a level to be established by the department. Retailers are protected from violations if they have a written certificate of compliance from the manufacturer, but providing a false certificate is a violation. Penalties for violating this section include civil penalties of up to $1,000 per day for a first offense and up to $2,500 per day for a second offense, and the violator may also be subject to an injunction to stop the violation. The bill will take effect 180 days after becoming law.
