This bill amends the Mental Health and Developmental Disabilities Administrative Act to establish a new requirement for the Department of Human Services (DHS) when an adult with a developmental disability (DD) loses their parental guardian. Specifically, within 6 months of learning about the loss of a parental guardian, DHS must request a wellness check from an adult protective services agency or provider agency. The purpose of this wellness check is twofold: first, to verify that the adult with a developmental disability is not experiencing or at imminent risk of abuse, neglect, exploitation, or self-neglect; and second, to create mandatory standards for providing emergency casework and follow-up services that aim to reduce the risk of harm or potential death to the vulnerable adult. This legislation is designed to provide an additional layer of protection and support for adults with developmental disabilities who may become particularly vulnerable after losing their primary caregiver.
