This bill amends the Illinois Marriage and Dissolution of Marriage Act by changing the definition of shared physical care for child support calculations. Previously, shared physical care was defined as a parent having 146 or more overnights per year with a child. The bill modifies this definition to require each parent to exercise 3,504 hours or more per year with the child (which is equivalent to about 146 days). When this shared physical care threshold is met, the basic child support obligation will be multiplied by 1.5 to calculate the shared care child support obligation. The court will then determine each parent's share of this obligation based on their percentage of combined net income. The respective child support obligations will be offset, with the parent owing more child support paying the difference between the calculated amounts. The Illinois Department of Healthcare and Family Services will be required to create a worksheet to calculate child support in shared physical care scenarios, using the standardized tax amount to determine net income.
