This bill amends the New York General Business Law by adding a new section requiring car wash facilities that display liability waiver signs to also include a notice informing customers of their right to file a complaint with the consumer protection division if they sustain damages to their vehicle during the car wash process. Specifically, the bill defines a car wash facility as a business primarily engaged in washing, waxing, and/or vacuuming motor vehicles. If a car wash facility posts a sign attempting to limit its liability for vehicle damages, it must now also clearly notify customers that they can still file a complaint with consumer protection authorities, regardless of any liability waiver. Businesses found in violation of this new requirement could face a civil penalty of up to $1,000. The law is designed to ensure consumers are aware of their rights and have a clear avenue for seeking recourse if their vehicle is damaged during a car wash service, even if the facility attempts to disclaim responsibility through signage.
