This bill creates the "Immigration and Customs Enforcement Support Act", which requires certain law enforcement agencies (including state police, county sheriffs, and local city/village/township law enforcement) to support federal immigration enforcement. Specifically, agencies can create two types of programs - a jail enforcement model or a warrant service officer program - but only if they receive funding from a new immigration enforcement support fund. Before implementing these programs, agencies must first sign a written agreement with the Department of Homeland Security under Section 287(g) of the immigration and nationality act, which allows local law enforcement to function as federal immigration agents. Participating agencies must designate officers to receive ICE-certified training and adopt a written policy incorporating the act's requirements. The bill mandates that law enforcement officers must attempt to verify the immigration status of detained individuals, transfer individuals not legally in the United States to ICE custody after serving criminal sentences, and participate in transporting such individuals to federal facilities. Importantly, the bill is tied to another piece of legislation (Senate Bill 42) and will only take effect if that bill is also enacted into law.
