This bill mandates the use of body imaging scanning equipment at correctional facilities for both visitors and incarcerated individuals. Specifically, all visitors must be scanned by body imaging equipment before entering a correctional facility, and all incarcerated individuals must be scanned upon intake and after any visitation. The bill removes previous language that allowed individuals to decline scanning and eliminates protections against harassment or disciplinary actions for choosing alternative screening methods. Instead, the new provisions allow the department to deny visitation to anyone who declines scanning for non-medical reasons. Body imaging scanning equipment is defined according to existing public health law, and the implementation of these scanners will be regulated by the state department of health or, in the case of New York City facilities, by the city's department of health and mental hygiene. The state commission of correction will work with the department of corrections and community supervision to establish specific guidelines for when and how these scanners will be used in state correctional facilities. The act takes effect immediately, with some technical provisions about the repeal of related legal sections.
