Bill Summary

Amends the Code of Criminal Procedure of 1963. Provides that there is a rebuttable presumption that the testimony of a victim who is a child under 13 years of age shall testify outside the courtroom and the child's testimony shall be shown in the courtroom by means of a 2-way closed circuit television (rather than closed circuit television). Provides that before the court permits the testimony of a victim outside the courtroom that is to be shown in the courtroom by means of a closed circuit television, the court must make a finding that the testimony by means of a 2-way closed circuit television (rather than closed circuit television) does not prejudice the defendant.

AI Summary

This bill amends the Code of Criminal Procedure of 1963 to modify how child victims under 13 years old can provide testimony in certain criminal cases involving offenses like sexual assault, aggravated battery, and domestic battery. The bill establishes a new presumption that child victims shall testify outside the courtroom using a two-way closed circuit television system, which is an upgrade from the previous single-direction closed circuit television approach. Before allowing this type of testimony, the court must first determine that using the two-way closed circuit television will not unfairly prejudice the defendant's rights. The bill maintains existing protections for the child victim, such as limiting who can be present during testimony to essential personnel like attorneys, the judge, and supportive individuals who can help the child feel more comfortable. The goal is to create a less traumatic testimony environment for young victims while still preserving the defendant's right to a fair trial by allowing real-time communication and observation during the testimony.
