This bill modifies the Texas Transportation Code to increase criminal penalties for reckless driving by establishing a new Class B misdemeanor category for certain dangerous driving behaviors. Under the new provisions, a driver can be charged with a Class B misdemeanor (which typically carries more serious consequences) if they cause a collision resulting in bodily injury while simultaneously meeting one of three specific conditions: driving 20 miles per hour or more over the speed limit in an urban district, driving 30 miles per hour or more over the speed limit outside an urban district, or using a portable wireless communication device while driving. Previously, reckless driving was a misdemeanor with a maximum fine of $200 and/or up to 30 days in county jail. The bill also clarifies that if the reckless driving conduct constitutes an offense under multiple laws, the driver can be prosecuted under this section, other applicable laws, or both. The changes will only apply to offenses committed on or after September 1, 2025, and offenses committed before that date will be governed by the previous legal standards.
